www.bork.ae is a website, along with all associated sub domains and the web pages (“Website”) owned and/or operated by BORK LUXURY GENERAL TRADING L.L.C (“BORK/We/Us/Our”). We are a limited liability company incorporated under the laws of the Emirate of Dubai with license no. 1156439, and have Our registered offices at Dubai, the Dubai Mall, land area Burj Khalifa, plot No. 156-0, Land DM no 345-897, Makani No. 26889 87732, unit No. SF 012.

WHAT’S IN THESE TERMS OF USE

These Terms of Use describe the legally binding terms and conditions that govern your use of Our Website and mobile applications (together the “Platforms”), and set out the Content Standards that apply when you upload content to the Platforms, make contact with other users on the Platforms, link to the Platforms, or interact with the Platforms in any other way. These Terms of Use are in place to protect the users thereof and our commercial interests. Inappropriate use exposes you and Us to cyber-based risks such as virus attacks and compromises to Our network systems and services, legal issues, and inconvenience.

The Platforms are for your personal, non-commercial, and non-exclusive use only.

Mobile applications may be hosted by Us or by other companies and you should refer to the relevant conditions of such other company.

BY USING THE PLATFORMS, YOU ACCEPT THESE TERMS OF USE

You are kindly asked to read these Terms of Use carefully before using the Platforms.

These Terms of Use take effect from the date when you first access the Platforms.

By using the Platforms, you explicitly agree to the Terms of Use, including the provisions regarding the processing of personal data under our Privacy Policy and you are to be legally bound to comply with them.

Please note that you are not authorized to continue using the Platforms if you do not agree to these Terms of Use.

We do not knowingly allow users under the age of 18 to use or otherwise access the Services of our Platforms. To be a user and subject to these Terms of Use as updated from time to time, you must be at least 18 years of age and must have the civil capacity for action under the federal laws of the United Arab Emirates. If you are under the age of 18, you may use the Platforms only under the supervision of a parent or legal guardian who agrees to be bound by these Terms of Use. If you are a parent or legal guardian agreeing to these Terms of Use on behalf of a person under the age of 18 years, you are fully responsible for his or her use of these Platforms, including all financial charges and legal liability that may be incurred. If you continue using the Platform, we assume that the aforementioned conditions are met.

WE MAY MAKE CHANGES TO THESE TERMS OF USE

We may make changes to these Terms of Use from time to time and the latest version will be published on the Platform. Every time you wish to use the Platforms, please check these terms to ensure you understand the terms that apply at that time, as they are legally binding on you. We may also send you notifications about changes, but you remain solely liable for checking the updates.

Any new version of these Terms of Use will take effect and will govern the use of the Platforms and your relationship with us immediately from the date of publication. By continuing to use the Platforms, you agree to comply with the terms of these updates and amendments. If you do not agree to the new terms, you must stop using the Platforms.

Any and all updates or upgrades you will need to install for your convenience and correct operation of the Platforms, shall be subject to this Term of Use unless other terms introduced by the updates and/or upgrades, in which case, those other terms shall apply.

These Terms of Use refer to the following additional terms, which also apply to your use of the Platforms:

Our Cancellation, Exchange and Return Policy.

OUR SERVICES (hereinafter referred to as the “Services”)

The Platform may be used to access the following Services free of charge:

Product browsing and selection;
Order placement;
Payment processing;
Order tracking;
Customer support;
Informational content access;
Promotional offers;
Subscription to the BORK Newsletter.

Certain Services ordered through the Platform may incur additional charges. These services include, but not limited to:

Shipping fees (if applicable);
Customization or personalization services (if applicable).

Please note that while we strive to provide transparency regarding any additional charges, specific fees may vary depending on factors such as product type, location, and selected Service options. The specific fees associated with each Service will be communicated to you prior to completing your order. Should you have any questions or require clarification regarding our Services please contact our customer support team for further assistance.

OUR PRODUCTS

Our Products (hereinafter referred to individually as “Product” and collectively as the “Products”) in these Terms of Use refer to the range of items available for purchase on our Platforms, including handcrafted home accessories, innovative beauty and wellness products, and premium household appliances. While we strive for consistency, please note that our product range may expand or change over time as we add new products or adjust our offerings based on customer demand and availability from suppliers. By using our Platforms, you understand and agree that details about our Products, such as descriptions, prices, and availability, may be subject to updates without prior notice.

We sell Our Products through our Platforms. It is important to take note of the following factors when shopping online from our Platforms:

Colours of the Products

The colours of the Products shown on the Platforms are not accurate and may vary depending on the display settings on your computer and/or other devices. The actual colours of the Products may be different to the Products colour appearing online.

Photos

The photos of the Products provided on Our platforms are for illustration purposes only. A description of the products will be provided and should be reviewed, along with the photos of the Products, prior to making the purchase from Our Platforms. Your placement of an order shall be deemed as having read any descriptions, notes, disclaimers and/or special instructions that might be written down.

Validity of the information

We shall try to ensure that the information provided on Our Platforms in relation to the Product description and prices is accurate and valid, however, errors may occur. In the event such an error affects your order, we shall notify you.

Product Availability

Although we constantly check the accuracy of our stock on Our Platforms, an error may occur. If we discover any stock error with any Product you ordered, we shall inform you as soon as possible.

Promotions

Promotion and offers on Our products may be provided on our Platforms, and shall be subject to such terms and conditions set forth by Us from time to time.

ORDER PLACEMENT

Order and Acceptance

Your placement of an order on Our Platforms represents an offer to purchase the particular Product from us. When you order more than one item, it represents a set of offers for each Product separately.

Upon receipt of your purchase order, we shall send you a confirmation email confirming if your offer to purchase has been accepted. Please pay attention when placing your purchase order, as you shall not be able to modify your purchase order subsequent to receiving the confirmation email. The confirmation email will outline the details of your purchase order and is deemed as an acceptance of your offer, and thus, giving rise to a sale / purchase agreement between us on these Terms of Use.

Please note that We are not bound to accept your purchase order. We may not accept your order in any of the following events:

The Product(s) ordered is/ are out of stock;
We are unable to obtain authorization on your payment;
There is an error in the Product or its pricing; or
For any other reasons at our own discretion.

In any of the above situations, We shall inform you that the order has not been accepted, and shall refund any amounts that you may have paid in relation to the order.

PRICE AND PAYMENT

The price of the Products will be as quoted on Our Platforms from time to time, except in cases of obvious error. Product prices include VAT at the prevailing rate. The price quoted on Our Platforms for Products excludes delivery charges which are quoted separately on Our Platforms.

Product prices and delivery charges (if applicable) are subject to change at any time, but changes will not affect orders in respect of which We have already sent you a confirmation email.

You shall make the payment at the time of placing your order on Our Platforms, which shall include the price of the Product(s) and any other services requested by you. Any payment on Our Platforms shall be made through a Visa or MasterCard credit/debit card in UAE Dirhams (AED).

All credit / debit card payments are subject to authorisation/ validation by the issuing bank. If the issuing bank refuses to authorise the payment, We shall cancel your order or contact you to check if an alternative method of payment can be arranged. We shall not be responsible if this results in a delay of the delivery of your Product(s) or Product(s) becoming out of stock.

Further, when you submit your payment details/information (including but not limited to, credit/debit card number, full name, billing address, home address, account number and expiration date of the credit/debit card) on Our Platforms to place an order, your payment details shall be provided directly to our payment provider via a secured connection. We shall not store or collect your payment information, and shall not be held responsible and/or liable for any losses suffered by you, whether directly or indirectly, as a result of you sharing your payment details/information on or through our Platforms. Any and all losses arising due to you sharing your payment information with our payment provider shall solely be the responsibility and liability of the payment provider.

The Products’ prices are set in UAE Dirhams (AED).

We also provide our customers with the option of paying for orders with Cash on Pickup (“COP”) or by bank card at our Boutique. The payment shall be accepted in UAE Dirhams, as displayed during checkout.

CANCELLATION, EXCHANGE AND REFUND

Please refer to Cancellation, Exchange and Return Policy for further details.

PRODUCT LIABILITY

By placing an order through our Platforms, you acknowledge and agree that full liability for the Products rests with the manufacturer and that, to the extent permitted by the applicable laws, we carry no product liability for those items save as described in the Returns section in Our Cancellation, Exchange and Return Policy.

TITLE TO GOODS

Risk of loss and title for the Products ordered passes to you upon full payment and acceptance of Product(s).

PRODUCT WARRANTIES

Our Products come with a manufacturer’s warranty. Details of the manufacturer’s warranty can be found with the documentation that comes with your product. Registration may be required to benefit from the warranty or any extended warranty.

LIMITED AND/OR PROHIBITED USE

Your use and access to the Platform and Services may be limited or suspended and your Account may be canceled in whole or in part, without advance notice to you in the following situations:

culpable violation of these Terms of Use and/or any of the applicable local, national, international laws or regulations;
pending debt for the fees payable for using or accessing complementary products and services subject to charge on time and in full (if applicable);
In case we are obliged to terminate our services and Platform in whole or in part due to legal requirements or mandatory requirements of competent authorities; or
unauthorized use or culpable misuse of the Platform and the Services;

BORK’s reasonable believe shall constitute the valid ground for the abovementioned actions.

You are strictly prohibited to use the Platforms for the following; which by no means constitute an exhaustive list:

Conducts that in any way breach any applicable local, national, or international law or regulation.
Conducts that in any way that is unlawful or fraudulent, or has any unlawful or fraudulent purpose or effect.
For the purpose of harming or attempting to harm minors in any way.
To bully, insult, intimidate or humiliate any person.
To send, knowingly receive, upload, download, use or re-use any material which does not comply with our Content’s Standards.
To transmit, or procure the sending of, any unsolicited or unauthorised advertising or promotional material or any other form of similar solicitation (spam).
To stimulate communications from Us or any other service or entity in order to collect identity information, authentication credentials, or other information (phishing).
To disrupt the operations of the Platforms or business or website or business of any other entity.
Violations of the rights of any person or company protected by copyright, trade secret, patent, or other intellectual property, or similar laws and/or regulations, including, but not limited to, the installation or distribution of "pirated" or other software products
To represent or suggest that We endorse any other business, product or service unless We have separately agreed to do so in writing.
To knowingly transmit any data, send or upload any material that contains viruses, Trojan horses, worms, time-bombs, keystroke loggers, spyware, adware or any other harmful programs or similar computer code designed to adversely affect the operation of any computer software or hardware.
Interfering with or denying service to any user (for example, denial of service attack).
To gain access to or use of computers, data, systems, accounts or networks.
Circumventing user authentication or security of any host, network or account.
Accessing the site for any purpose other than conducting normal business.

We may also make changes to, suspend, or terminate the Services (i) if it is necessary due to applicable law or legal process, litigation, and/or requests from public and governmental authorities, (ii) in the course of the further development of the Platforms, (iii) for reasonable technical reasons, (iv) due to reasonable operational requirements (including merger, division, acquisition or asset transfer), or (v) if the suspension, termination or change is for the benefit of users.

Although our Services and Platforms can be used or accessed worldwide, the functionalities of Platform and the Services accessible in certain countries/regions might differ or be limited, comparing to those available in other countries/regions. You understand and agree that some or all features of Platform and services may not be available or suitable for use in certain countries / regions. We waive all responsibility for any damage or loss caused by your use Platforms and Services if you choose to use the Platform and Services, even though you meet deviations from normal use and you rest solely responsible for compliance with the applicable local laws.

HOW YOU MAY USE MATERIAL ON OUR WEBSITES

Our Platforms are designed and created for the purposes of providing information and Services for your personal use. You may download or print the material made available to you via the Platforms, or download the application on to your mobile device, for your own non-commercial, private or domestic use only, provided that proprietary notices, in particular intellectual property notices such as copyright©, trademark™, are preserved intact and are not exploited, modified, deleted or changed.

Unless otherwise stated, you should assume that all the intellectual property digitally contained, offered, displayed, and disclosed through the Platforms (such as images, photographs, including any person represented in the photographs, illustrations, icons, texts, video clips, music, written and other materials) (“BORK Material”) are protected by legislation such as copyright, designs and trademark legislation and under international treaty provisions and national laws worldwide. You shall abide by all copyright notices, trademark rules, information, and restrictions contained in any BORK Material accessed through the Platforms, and shall not use, copy, reproduce, modify, translate, publish, broadcast, transmit, distribute, perform, upload, display, license, sell or otherwise exploit for any purposes whatsoever any BORK Material or third party submissions or other proprietary rights not owned by you: (i) without the express prior written consent of the respective owners, and to reproduce, duplicate, copy or re-sell any part of the Platforms in contravention of the provisions of these Terms of Use. In any case you shall be solely liable for any breach of law or/and infringe of intellectual property rights caused by unauthorized use of BORK Materials.

You also agree not to access without authority, interfere with, damage or disrupt:

any part of the Platforms;
any equipment or network on which the Platforms are stored;
any software used in the provision of the Platform; or
any equipment or network or software owned or used by any third party.

INTERACTIVE SERVICES

We may from time to time provide interactive services on the Platforms.

Where We do provide any interactive service, We will provide clear information to you about the kind of service offered, if it is moderated, and what form of moderation is used (including whether it is human or technical).

When using any of our Interactive Services users shall keep their interactions within the abovementioned restrictions and limitations, and in line with our Content Standards as stipulated below.

INFORMATION ON VIOLATION OF THE POLICY

We request that anyone who believes that there is a violation of these Terms of Use to direct the information to the appropriate contact set forth above. If available, please provide the following information: (i) the IP address used to commit the alleged violation; (ii) the date and time of the alleged violation, including the time zone; and (iii) evidence of the alleged violation. When reporting an issue regarding unsolicited email please provide a copy of the email messages with full headers which typically provides all of the above data. Other situations will require different methods of providing the necessary information.

DISCLAIMER OF WARRANTIES AND LIMITATION OF LIABILITY

We make no representations or warranties, either expressed or implied, with respect to Our Platforms or the BORK Materials and to the fullest extent permissible under the law, disclaim all such representations and warranties.

Your access to and use of software and other materials on or through Our Platforms is solely at your own risk.

We make no warranty whatsoever about the reliability, stability, or virus-free nature of such software.

We do Our best to make your experience with us smooth and satisfying, provided to the extent our existing technologies and conditions can achieve, and we are eager to ensure the continuity and security of our services. However, due to legal, technical and other risks that we cannot foresee, prevent and are out of our control, along with force majeure events (including but not limited to, natural disasters such as floods, earthquakes, large-scale plague and other epidemics, and storms, and social events such as strikes, wars, turmoil, and government actions), such as password stealing ware (Trojan Horse), viruses, hackers’ attacks, defected equipment, general system instability, discontinuance of network connections on your side, actions of the authorities etc. service suspension, data loss, and other losses may occur for which we, to the fullest extent permitted by law, fully waive our liability.

Unless expressly stated to the contrary; to the fullest extent permitted by law, the Platforms, Our suppliers, content providers, and advertisers hereby expressly exclude all conditions, warranties, and other terms which might otherwise be implied by statute, common law, or the law of equity; and shall not be liable for any damages whatsoever, including but without limitation to any direct, indirect, special, consequential, punitive, or incidental damages, or damages for loss of use, profits, data or other intangibles, damage to goodwill or reputation, or the cost of procurement of substitute goods and services, arising out of or related to the use, inability to use, performance, or failures of the Platforms or the linked sites and any BORK Material or other material posted thereon, irrespective of whether such damages were foreseeable or arise in contract, tort, equity, restitution, by statute, at common law or otherwise.

WE ARE NOT RESPONSIBLE FOR WEBSITES WE LINK TO

The Platform may contain links to sites and materials that belong to third parties, and these links are provided for your information and convenience only. BORK is not responsible for any information posted on the websites of third parties to which you may navigate through the Platform. If you use such links, you will leave our Platforms. We have not reviewed all of these third-party websites and are not responsible for these websites, including their content or availability and the conduct of the proprietors of such websites. Such links should not be interpreted as approval by Us of those linked websites or information you may obtain from them. The inclusion of these links on the Platforms does not imply any endorsement or approval of the linked sites or the content, information or any linked addresses therein, or make any representations about them, or any material found there, or any results that may be obtained from using them.

We have no control over the linked sites and accept no responsibility for them or for any loss or damage that may arise from your use of them. Your use of the linked sites will be subject to the terms of use and service contained within each such site. If you decide to access any of the third-party websites linked to the Websites, You do so entirely at your own risk.

DATA ANALYSIS

We and third-party internet service providers, for the purpose of non-personalized analysis of the interests of customers and potential customers, collect statistical data on views of the Platform. The data collected in this case are anonymous and generalized and thus do not allow to define specific user it refers to.

BREACH OF TERMS OF USE

Without prejudice to our other rights under these Terms of Use, if you breach these Terms of Use, whether directly or indirectly, we may take such action as we deem appropriate to deal with the breach, including but not limited to, suspending your access to our Website, prohibiting you from accessing the Platform, blocking your device using your IP address from accessing the Platform, contacting your internet service provider to request that they block your access to the Platform and/or bringing legal or court proceedings against you.

GENERAL PROVISIONS

Please note that these Terms of Use are governed by and construed in accordance with the applicable federal laws of the United Arab Emirates. The parties hereby consent to exclusive jurisdiction and venue of the courts located in Dubai in any action to enforce (or otherwise relating to) these Terms of Use.

If any provision, or part of a provision, of these Terms of Use is found to be illegal, invalid or unenforceable, that provision or part-provision shall be deemed not to form part of these Terms of Use, and the legality, validity or enforceability of the remainder of the provisions of these Terms of Use shall not be affected, unless otherwise required by operation of applicable law.

These Terms of Use constitute the entire agreement between you and Us in relation to the use of the Platforms, and replace and extinguish all prior agreements, draft agreements, arrangements, undertakings, or collateral contracts of any nature, whether oral or written, in relation to such subject matter.

The waiver by BORK of a breach of any provision of these Terms of Use shall not to be deemed as a waiver of any other or subsequent breach.

ملكية البضائع

ضمانات المنتج

تأتي منتجاتنا مع ضمان من الشركة المصنعة. يمكن العثور على تفاصيل ضمان الشركة المصنعة في المستندات المرفقة مع المنتج الخاص بك. قد يلزم التسجيل لاستفادة من الضمان أو أي ضمان موسع.

الاستخدام المحدود و/أو الممنوع

قد يتم تقييد أو تعليق استخدامك والوصول إلى المنصة والخدمات، وإلغاء حسابك كليًا أو جزئيًا، دون إخطار مسبق إليك في الحالات التالية:

أ) انتهاك متعمد لهذه "شروط الاستخدام" و/أو أي من القوانين أو اللوائح المحلية أو الوطنية أو الدولية المطبقة؛

ب) وجود دين مستحق للرسوم المستحقة الدفع لاستخدام أو الوصول إلى المنتجات والخدمات التكميلية الخاضعة للرسوم في الوقت المناسب وبالكامل (إن وجدت)؛

ج) في حالة إلزامنا بإنهاء خدماتنا ومنصتنا كليًا أو جزئيًا بسبب متطلبات قانونية أو متطلبات إلزامية للسلطات المختصة؛ أو

د) الاستخدام غير المصرح به أو الاستخدام الخاطئ المتعمد للمنصة والخدمات.

تشكل قناعة بورك المعقولة الأساس الصالح للإجراءات المذكورة أعلاه.

يُمنع عليك بشكل صارم استخدام المنصات للأغراض التالية، والتي لا تعد قائمة شاملة:

السلوكيات التي تنتهك بأي شكل من الأشكال أي قانون أو لائحة محلية أو وطنية أو دولية معمول بها.
السلوكيات غير القانونية أو الاحتيالية بأي شكل من الأشكال، أو التي لها غرض أو تأثير غير قانوني أو احتيالي.
بغرض إلحاق الضرر بالقُصَّر أو محاولة إلحاق الضرر بهم بأي شكل من الأشكال.
للتنمر أو التجريح أو الترهيب أو الإذلال لأي شخص.
لإرسال أو استلام أو تحميل أو تنزيل أو استخدام أو إعادة استخدام أي مواد لا تتوافق مع معايير المحتوى الخاصة بنا.
لإرسال أو تسهيل إرسال أي إعلان أو ترويج غير مطلوب أو غير مصرح به أو أي شكل آخر من أشكال الطلب المماثلة (البريد العشوائي).
لتحفيز الاتصالات من قبلنا أو أي خدمة أو كيان آخر من أجل جمع معلومات الهوية أو بيانات المصادقة أو معلومات أخرى (التصيد الاحتيالي).
لتعطيل عمليات المنصات أو الأعمال أو الموقع الإلكتروني أو أعمال أي كيان آخر.
انتهاكات لحقوق أي شخص أو شركة محمية بموجب حقوق النشر أو سر التجاري أو براءة الاختراع أو أي ملكية فكرية أخرى أو قوانين و/أو لوائح مماثلة، بما في ذلك على سبيل المثال لا الحصر، تثبيت أو توزيع برامج كمبيوتر "متداولة" أو أخرى.
لتمثيل أو الإشارة إلى أننا ننصح أي عمل تجاري أو منتج أو خدمة آخر ما لم نوافق على ذلك كتابيًا بشكل منفصل.
لنقل عن عمد أي بيانات أو إرسال أو تحميل أي مواد تحتوي على فيروسات أو برامج خبيثة أو برامج ضارة أو برامج تعمل في الخفاء أو برامج إعلانية أو أي برامج أخرى ضارة مصممة لإعاقة تشغيل أي برامج أو أجهزة كمبيوتر.
التداخل مع أي مستخدم أو منع الخدمة (على سبيل المثال، هجوم حرمان الخدمة).
للحصول على الوصول إلى أو استخدام أجهزة الكمبيوتر أو البيانات أو الأنظمة أو الحسابات أو الشبكات.
التحايل على مصادقة المستخدم أو أمان أي مضيف أو شبكة أو حساب.
الوصول إلى الموقع لأي غرض آخر بخلاف إجراء الأعمال العادية.

قد نقوم أيضًا بإجراء تغييرات على الخدمات أو تعليقها أو إنهائها (i) إذا كان ذلك ضروريًا بسبب القانون المطبق أو الإجراءات القانونية أو النزاعات القضائية و/أو الطلبات من السلطات العامة والحكومية، (ii) في سياق التطوير المستمر للمنصات، (iii) لأسباب تقنية معقولة، (iv) بسبب المتطلبات التشغيلية المعقولة (بما في ذلك الاندماج أو التقسيم أو الاستحواذ أو نقل الأصول)، أو (v) إذا كان التعليق أو الإنهاء أو التغيير لصالح المستخدمين.

كما توافق على عدم الوصول بدون تصريح أو التدخل أو الإضرار أو تعطيل:

أي جزء من المنصات؛
أي معدات أو شبكة يتم تخزين المنصات عليها؛
أي برامج مستخدمة في توفير المنصة؛ أو
أي معدات أو شبكة أو برامج مملوكة أو مستخدمة من قبل طرف ثالث.

الخدمات التفاعلية

قد نوفر خدمات تفاعلية على المنصات من وقت لآخر.

عندما نوفر أي خدمة تفاعلية، سنوفر لك معلومات واضحة عن نوع الخدمة المقدمة، وما إذا كانت مرشدة، وما هي صيغة الرقابة المستخدمة (بما في ذلك ما إذا كانت بشرية أو تقنية).

عند استخدام أي من خدماتنا التفاعلية، يجب على المستخدمين الحفاظ على تفاعلاتهم ضمن القيود والحدود المذكورة أعلاه، وبما يتماشى مع معايير المحتوى الخاصة بنا كما هو مبين أدناه.

معلومات انتهاك السياسة

إذا وجد أي حكم، أو جزء من حكم، من هذه الشروط والأحكام أنه غير قانوني أو باطل أو غير قابل للإنفاذ، فسيُعتبر أن هذا الحكم أو الجزء منه لا يشكل جزءًا من هذه الشروط والأحكام، ولن تتأثر شرعية أو صلاحية أو إنفاذ بقية أحكام هذه الشروط والأحكام، ما لم يكن ذلك مطلوبًا بخلاف ذلك بموجب عملية القانون المعمول به.

تشكل هذه الشروط والأحكام الاتفاقية الكاملة بينك وبيننا فيما يتعلق باستخدام المنصات، وتحل محل وتلغي جميع الاتفاقيات السابقة والاتفاقيات المقترحة والترتيبات والتعهدات أو العقود الجانبية من أي طبيعة، سواء كانت شفهية أو خطية، فيما يتعلق بهذا الموضوع.

لا يُعتبر تنازل بورك عن انتهاك لأي حكم من هذه الشروط والأحكام على أنه تنازل عن أي انتهاك آخر أو لاحق.
